Terms of Service

LEGAL NOTICE:
By authorizing a Mr. Fridge Austin technician to begin service, you agree to the following Terms & Conditions of Service (“Agreement”), which govern all service work, diagnostics, repairs, and parts provided by Mr. Fridge Austin. This Agreement, together with any approved service order or invoice, forms the entire agreement between you (“Customer”) and Mr. Fridge Austin and supersedes any prior verbal or written discussions or understandings.

1. Diagnostic Visit Fee (Non-Refundable)
A non-refundable diagnostic fee is required for all non-warranty service calls. This fee covers technician travel time, on-site inspection, and system assessment. If you approve the recommended repair or service, the diagnostic fee will be credited toward the total service cost.

2. Limited Warranty
All parts are supplied subject only to the manufacturer’s warranty. Mr. Fridge Austin provides no additional warranty on parts except where required by applicable law.

Labor performed by Mr. Fridge Austin is warranted for up to one (1) year from the date of completion. This labor warranty applies only to defects in workmanship directly related to parts installed or replaced by Mr. Fridge Austin. It does not cover failures caused by misuse, lack of maintenance, improper operation, alterations or repairs by others, power issues, environmental conditions, or any circumstance beyond the control of Mr. Fridge Austin.

Any warranty claim must be reported promptly. Warranty coverage is void if the original invoice has not been paid in full.

3. Limitation of Liability
Mr. Fridge Austin is not liable for indirect, incidental, special, consequential, or punitive damages related to equipment failure, service delays, loss of product, spoilage, revenue loss, interruption of business, or other related damages.

To the fullest extent permitted by law, Mr. Fridge Austin’s total liability shall not exceed the amount paid by the Customer for the specific service giving rise to the claim. This limitation does not apply where prohibited by law.

4. Damage Waivers
By authorizing service, you acknowledge and accept that certain repair conditions carry inherent risks. Mr. Fridge Austin shall not be responsible for incidental damage unless caused by gross negligence or willful misconduct.

This includes, but is not limited to:

Moving Equipment
Some service calls require refrigeration units or related components to be moved or repositioned. Mr. Fridge Austin is not responsible for incidental damage to floors, walls, cabinetry, surrounding finishes, or nearby surfaces resulting from necessary equipment access or movement.

Working Near Water or Drain Lines
Repairs involving plumbing connections, drain lines, or condensate systems may carry a risk of leakage or water-related damage. Mr. Fridge Austin is not responsible for water damage unless gross negligence is proven.

Equipment Failure and Product Loss
Commercial refrigeration systems may fail unexpectedly before, during, or after service, including due to age, hidden defects, refrigerant issues, electrical faults, or unrelated component failure. The Customer accepts responsibility for spoilage, inventory loss, downtime, lost revenue, and operational interruption.

Handling Delicate Components
Certain repairs require removal or handling of fragile parts such as glass, panels, trim pieces, shelving, and aged components that may already be weakened. Mr. Fridge Austin is not liable for breakage of fragile or deteriorated parts when access or disassembly is reasonably necessary to perform service.

5. Dispute Resolution / Arbitration
Any dispute, claim, or controversy arising out of or relating to the services provided by Mr. Fridge Austin shall be resolved in accordance with applicable Texas law. Where enforceable, such disputes shall be submitted to binding arbitration in lieu of court litigation, except for matters that may be brought in small claims court or where otherwise prohibited by law.
